样品；样本；货样
一个或数个或小量能够代表买卖标的物品质或形状的现货。凭样品交易，卖方日後所交付的正货须与样品相符，如所交付正货与样品不符，买方可拒绝受领或解除契约，并要求损害赔偿，因此，样品必须从待售的整批货物中以抽样方式抽出，而能代表全体待售货物品质者。若样品并非从待售货物中抽取，而仅为类似样品(similar sample)者，应先取得买方的谅解，并於契约中加列宽容条款(allowance clause)。 |
