reasonable care
合理的注意；相当的注意
在英美法上，所谓合理的注意，乃指一合理的人(reasonable man)或具有理性的人於行为人为同一情况下所为的注意而言。依我国民法学说，合理的注意与「善良管理人的注意」相当，亦即有相当的知识、经验及诚意的人，处理事务应有的注意。根据信用状统一惯例(*UCP)第十五条的规定，银行须以合理的注意，审查一切单证，以确定单据表面上所显示者完全符合信用状所指示的各项条件，始能履行付款义务。 |
